Socceroo wins $67,000 case against agent

The former manager and agent of Socceroos player Scott Chipperfield has been ordered to pay him $67,000 after a NSW industrial tribunal found the sportsman had been exploited.

Chipperfield, who will be part of Australia's campaign at this year's World Cup in Germany, entered into a verbal players agency agreement with Alain Barataud in May 2001.

Barataud facilitated the midfielder's transfer from the Wollongong Wolves to Swiss club Basel FC, worth about $100,000, which was finalised on June 26, 2001.

According to Chipperfield's agreement with the Wolves, the player was to receive 10 per cent of the $100,000 transfer fee received by the team from Basel FC.

Chipperfield authorised Barataud to collect his 10 per cent transfer fee from the Wolves, but the cheque the agent subsequently wrote for the player for $10,000 bounced.

Chipperfield later paid Barataud $6,000 after the manager told him he was owed a fee for making the arrangements with Basel FC.

In 2002, Chipperfield also paid Barataud $35,000 for a 20 per cent stake in the agent's company Australian Beach Soccer Management Pty Ltd which aimed to start up an Australian professional beach soccer league.

But Chipperfield was never given any shares in the company.

IRC Justice Conrad Staff on Thursday ruled in favour of Chipperfield labelling the players' contract between Chipperfield and Barataud unfair.

"The evidence led in this case, in my view, amounts to oppressive exploitation," Justice Staff said in his judgment.

"There can be no doubt that the evidence demonstrated the requisite unfairness of the contract and the respondent's unconscionable conduct towards the applicant."

He said the oral and written players' contract contained terms that permitted Barataud to obtain and claim payments from Chipperfield "in circumstances where the respondent performed no work and provided no service to the applicant".

Justice Staff ordered Barataud to pay Chipperfield $51,000, plus $16,065 in interest, as well as his legal costs.
